COLUMN: From the legislature - How the shall vs. may issue effects concealed weapons in Onondaga County

— Conflicting outcomes among the circuit courts on the same question create what is known as a “circuit split,” which would normally be resolved by the Supreme Court. However, the high court recently declined to hear an appeal of the Second Circuit ruling that upheld the “may issue” policy. This means the Supreme Court will have to grant an appeal in one of the related cases or individual county court judges will need to exercise their discretion differently if there is any hope that the residents of Onondaga County will be able to exercise their Second Amendment rights to both keep and bear arms as I believe the founders clearly intended.
