Manlius village planning board rules Ironwood and Café 119 have adequate parking

— In the wake of the Manlius village board’s discussions of the parking situation concerning the lot behind the 100 block of East Seneca St., the owner of the private lot, Mike Magley, wrote a letter to the planning board citing the village code and Ironwood and Café 119’s alleged violations concerning it. The planning board discussed the issue at its March 6 meeting and came to the conclusion that neither business was in the wrong by failing to present a parking plan when each respective owner appeared before the board.

In his letter, Magley quoted section 99-26 of the Manlius village code, which states: “Permanent off-street parking spaces shall be provided and satisfactorily maintained by the owner of the property for each building which, after the date when this chapter becomes effective, is erected, enlarged, altered or changed for use for any purpose.”

Mayor Mark-Paul Serafin stated at the meeting that when Café 119 opened in 2002, part of the lot was still municipal, so owner Chuck Porto did not have to worry about parking at that point. Magley believes that when Café 119 briefly became “The Purple Hippo” bakery in 2011, Porto should have had to re-appear before the board. Porto insists that his business never closed and therefore no new parking plan was needed.

“I didn’t reopen. We never closed, never got rid of the LLC, never got rid of my liquor license, everything stayed in place,” Porto said. “I never did go out of business, it was always in my name and it was always the café – I sell baked goods as it is now – am I still a bakery?”

Ironwood, which opened in Nov. 2012, did appear before the planning board, but was not required to present a parking plan. Village engineer Doug Miller sat in front of the board and reported that the village codes department does not require a parking review for each business.
