Marcellus Town Board could appoint new councilor Jan. 3

— The Marcellus Town Board met Monday night and set an organizational meeting for 5 p.m. Tuesday, Jan. 3, at town hall.

“The big item on that agenda will be filling the vacancy on the town board,” said Town Supervisor Daniel Ross.

November’s election resulted in a tie between current board member Don Sherman and challenger Mary Jo Paul, who is currently a village trustee.

“Because it’s a tie the position is deemed to be vacant,” Ross said. “So the procedure is the town board fills the vacancy. That person serves for one year through the next general election.”

A board member will motion to appoint someone to the open position, followed by a vote by the board. The board is not limited to appointing either Sherman or Paul, Ross said.

“It could be anybody, but I assume it’ll be one of those two,” Ross said, “It’s the same [procedure] as if somebody resigned from the board.”

The board also has the option to leave the position vacant until the next election cycle, Ross said.

The winner of the November 2012 election will serve the term’s remaining three years.

Last week’s meeting also served as a public hearing for the proposed local law amending subdivision regulations.

“We’ve been trying to update our subdivision regulations for a number of years,” Ross said. “Every once in a while a couple things pop up.”

Ross said Marcellus has a procedure that every subdivision has to be reviewed by the county.

“So if you have plot of, let’s say farmland, and you want to divide that up into forty building lots, you have to go through a subdivision process,” Ross said. “It’s a fairly lengthy process. We tried to speed that up with minor lot line revisions.”

Another discussion dealt with hydrofracking. Marcellus has a one-year moratorium in place to prevent drilling. The question of banning hydrofracking completely was brought up.
