A homeowner waiting on a zone change will have to wait a little longer before he can sell his property under BG or business/general zoning.
Jim Dennis, who owns property at 7878 Route 13, requested a zone change from agricultural/residential to BG due to hardship in selling the property.
Dennis and his realtor, Dean Shlotzhauer attended a public hearing on Feb. 12 with the Lenox board.
Also attending was property owner to the north of Dennis, Steve Newton. Newton who lives in Ilion said he is also trying to sell his lot and was looking to be included in the zone change. But before the zoning can be approved, Newton has paperwork to fill out and a boundary description must be done.
"Do we have to wait another month now? Shlotzhauer asked.
Town Supervisor Rocco DiVeronica said technically yes or otherwise it would be spot zoning. But because the Dennis property is grandfathered as a construction business, he could show the property with the intent the zone change would be approved. Also, anyone buying the property could use it as is.
"I'm just looking for the same opportunity as my neighbors have," Dennis said. Dennis wanted to know how his property got left out when the zoning was changed for Canastota Kart Speedway, located across the road.
"Wasn't that spot zoning?" Dennis asked.
"I can't answer that," DiVeronica said. "We don't get involved in the planning or zoning board's decisions."
